(1) If a person suffers loss due to official misconduct by a notary public, the aggrieved person may file a complaint in the relevant district court within two years from the date of such official misconduct and collect compensation from him.
(2) Notwithstanding anything contained in sub-section (1), the person signing the document or his representative shall be equally liable for such damages for misconduct committed by the notary public in the following cases:-
(a) official misconduct committed in the course of the person signing the instrument, and
(b) Knowing that the notary public is about to commit official misconduct, he agreed to do so.
